Effective date: The effective date of the final rule including adoption of the revised form is December 10, 2020.
The Commodity Futures Trading Commission (CFTC or Commission) is amending the Commission’s Rules (Final Rules) on Commodity Pool Operators (CPOs) and Commodity Trading Advisors Supplemental Reporting and Commodity Trading Advisors and CPO-PQR (also Form). Commission: Eliminate existing Program B and C Forms CPO-PQR, except for the investment program; to amend information requirements and guidelines to request legal entity identifiers (LEIs) for CPOs and their managed pools, and to remove requests from pool auditors and marketers; and making certain other changes resulting from the repeal of Schedules B and C, including the removal of all existing reporting restrictions. Under the final rule, all reporting CPOs are required to submit a revised CPO-PQR (Revised CPO-PQR or Revised Form) on a quarterly basis. The final rule also amends the Commission’s rules to require CPOs who submit a PQR report on the same form required by the National Futures Association (NFA) instead of submitting the Commission’s revised form. Conversely, Form PF in place of the revised form will no longer be accepted, although the Commission Form will remain.
